“A considerable internal debate unfolded within the Biden-Harris administration concerning the scope of Title IX protections,” explained The Times. “One faction argued that distinctions between allowing transgender students access to facilities aligned with their gender identity and permitting them to compete on sports teams based on that same identity were nonexistent.” This viewpoint centered on equality in access, specifically regarding restroom usage.

Conversely, “President Biden reportedly maintained a different perspective – one prioritizing the competitive dynamics of sports. He believed the inherent advantages some transgender athletes might possess posed an unfair imbalance within traditionally female athletic competitions,” according to sources close to the former president. “The focus was on the potential for a zero-sum scenario where certain athletes could outperform women in specific areas.”

A key figure supporting this stance was Biden himself, as confirmed by multiple former administration officials who cited his particular concern about competitive fairness.

Interestingly, the White House largely remained silent on the issue until 2023, a strategic decision to avoid intensifying the debate surrounding the upcoming 2022 midterm elections.

Title IX Background: Passed in 1972, Title IX prohibits sex-based discrimination in educational institutions receiving federal funding.
